Terms and Conditions Overview

• These terms and conditions of sale constitute the sales agreement between the customer and Web-enz.com as pertaining to the agreement for Web-enz.com to supply products and/or services and constitute a binding contract between the customer and Web-enz.com.
• Web-enz.com reserves the right to change the terms and conditions of sale without prior notice.
• The customer agrees to correspond by email and receive electronic records, which may be obtained via a web browser or e-mail application connected to the Internet.
• The terms and conditions of sale contained here, or written in Web-enz.com's invoice or other documentation will be that which governs the sale, and the customer must agree to this.
• A customer may negotiate an individual sales agreement if Web-enz.com is willing to negotiate.
• Web-enz.com will retain all customer information in confidence.

1. Terms and Conditions of Sales of Products and Services

• All goods including software must be fully paid for prior to delivery
• All internet advertising must be pre paid.
  • Advertising once placed may be edited for correction.
  • Web-enz.com guarantees unconditionally that where advertising is placed for a specified number of clicks, that that advertising shall remain on the Web-enz.com network until the agreed number of clicks have been reached.
• Any use of software purchased from Web-enz.com that breaks the sales contract will be prosecuted to the fullest extent of the law.
  • This applies to the license for use, i.e. purchasing one license when using software in multiple applications.  
• All services require a minimum deposit of 50% to be paid before any work commences and full payment on completion of contracted work.
• Each service or product may have a separate governing contract.
  • It is imperative that you, the customer, read the terms and conditions of sale pertaining to your purchase carefully.
• Sales Terms and Conditions are limited to those contained in this statement and New Zealand consumer law.
  • When accepting the delivery of any services and products from Web-enz.com, the customer accepts these terms and conditions and is bound to this agreement of sale unless Web-enz.com and the said customer have authorized and signed a separate document stating otherwise.

2. Refund Policy on Services

• Web-enz.com does not offer any refunds for any completed work or services rendered unless stated otherwise in the governing contract(s).

3. Refund Policy on Sales of Goods and Software

• Web-enz.com will only refund monies paid for goods or software if the goods or software is found to be in some way defective.
• If the software does not perform on the customers' server according to the product specifications, and our support department is unable to fix the problem, then the customer must return the software within a 30 day grace period, in order to qualify for a refund.
  • The end user to determine prior to purchase that software will meet end user requirements.

4. Refund Policy on Advertising

• There are no refunds for any advertising placed within our networks.

5. Governing Law

• The Laws of the New Zealand will govern these Terms and Conditions of Sale and any Sale dealing with Web-enz.com and the customer without witness to conflicts of Laws or Rules.
• Any arbitration, application of an arbitration or litigation will be rendered in Christchurch New Zealand. 

6. Limitation of Liability

• Neither Web-enz.com nor its associates will be liable for lost profits, theft or business, personal or billing information that is submitted through the site, or other considerable, special, direct or indirect damages, even if advised of the possible occurrence of such damages, or for any claim by any third party.
• Neither Web-enz.com nor its associates will be held liable for products not available for use, or lost, damaged or corrupted, or for data or software and the performance of software due to incorrect application or misuse.
• The customer consents that neither Web-enz.com or its associates are liable or responsible for any amount of damages above the dollar amount paid by the customer for the product(s) or service(s) that commences their claim.
• Any claims against Web-enz.com software will render any user licenses null and void, and the customer surrender all right to the said software.
• Should you have any questions, you may refer to your contract or contact your sales and/or project manager.

7. Internet Disclaimer

• Your connection to the internet requires access services from your local internet provider.
• Please contact your local provider for details and questions regarding your connectivity.
• Web-enz.com will not be involved in nor accept any responsibility relating to internet connections to customers computers or web servers.
• Web-enz.com has no responsibility relating to public access to this web site or the links or services or content of any site within this network or connected to this network.
• Web-enz.com does not guarantee that this or any web site will be accessible 100% of the time as the internet is not 100% stable.
